Terms of Service

1. Acceptance of terms

By accessing or using the Sane mobile application (available on iOS and Android), our website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.

2. Description of service

Sane is a mental wellness application that provides tools for:

• Mood tracking — Log your mood on a 1–10 scale with labels, energy levels, stress levels, triggers, activities, and notes.
• Voice check-ins — Real-time voice conversations with an AI wellness companion, with automatic transcription and emotional analysis.
• Goal tracking — Create and manage wellness goals with customisable categories, step-by-step progress, daily tasks, streak tracking, and calendar-based history views.
• AI-powered insights — Personalised daily prompts, follow-up questions, memory-based check-ins, mood pattern recognition, and goal reflections generated from your data.
• Dashboard and analytics — Weekly progress visualisations, streak counters, mood trend graphs, and calendar-based goal completion views.

3. Not medical advice

Sane is not a medical device and does not provide medical advice, diagnosis, or treatment. The Service, including all AI-generated insights and voice check-in responses, is not a substitute for professional mental health care, therapy, or counselling. The AI companion is designed for general wellness support only.

If you are experiencing a mental health crisis, suicidal thoughts, or a medical emergency, stop using Sane and immediately contact your local emergency services, a crisis helpline, or a qualified healthcare professional. Sane is not an emergency service and cannot provide crisis intervention.

4. User accounts

To access most features, you must create an account using a supported sign-in provider. You are responsible for maintaining the security of your account credentials and the devices you use to access Sane. You agree to provide accurate information when creating your account and to keep your details up to date. You are responsible for all activity that occurs under your account.

You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to create an account and use the Service.

5. Acceptable use

You agree to use Sane only for its intended purpose as a personal wellness tool. You may not:

• Use the Service to harass, abuse, threaten, or harm others.
• Distribute malicious software or attempt to compromise the security of the Service.
• Attempt to access other users' accounts or data.
• Reverse-engineer, decompile, or disassemble any part of the application.
• Use automated scripts, bots, or scrapers to access the Service.
• Misuse the voice check-in feature to generate content that is harmful, illegal, or violates the rights of others.
• Use the AI features to attempt to extract system instructions, model weights, or proprietary information.
• Circumvent any rate limits, authentication mechanisms, or technical restrictions.

6. Your content

You retain ownership of all mood entries, voice transcripts, goal data, notes, and other content you create in Sane ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely to provide and improve the Service for you. This includes processing Your Content through AI services to generate personalised insights, memory extractions, and follow-up prompts.

We will not share Your Content with other users, advertisers, or data brokers. We will not use Your Content to train machine learning models on other users' data.

7. AI-generated content

The Service uses third-party AI to generate insights, prompts, voice responses, emotional analysis, and visual styling for goals. You acknowledge that:

• AI-generated content is provided for informational and reflective purposes only and may not always be accurate, complete, or appropriate.
• Emotional analysis, sentiment classification, and confidence scores are algorithmic approximations and should not be relied upon as clinical assessments.
• AI-extracted memories (summaries, topics, concerns, takeaways) are derived from your input and may occasionally be inaccurate or out of context.
• Voice check-in conversations are guided by configurable AI system instructions focused on wellness; the AI is not a therapist and its responses should not be treated as professional guidance.
• We may update, modify, or change the AI models and providers we use at any time without prior notice.

8. Voice check-ins

When you use the voice check-in feature, you consent to your voice audio being streamed in real time to a third-party AI provider for processing. Audio is used for transcription and conversational response only; raw audio is not permanently stored. The text transcript and conversation history are stored on our servers as part of your wellness record.

Voice sessions may include automatic features such as greeting timeouts, silence nudge prompts, and session auto-disconnection after periods of inactivity. You can end a voice session at any time.

9. Intellectual property

The Sane name, logo, design, software, and all associated materials are the property of Sane. The Service is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of any part of the Service without prior written permission.

10. Third-party services

The Service integrates with third-party providers for AI processing, authentication, database hosting, and mobile infrastructure. Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the practices or availability of third-party services.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

• The Service will be uninterrupted, timely, secure, or error-free.
• AI-generated insights, analysis, or voice responses will be accurate, reliable, or suitable for any particular purpose.
• The Service will meet your specific requirements or expectations.
• Streak data, progress calculations, or analytics will be free from errors.

12. Limitation of liability

To the maximum extent permitted by applicable law, Sane and its team, officers, directors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to damages for loss of data, loss of wellness progress, emotional distress, or reliance on AI-generated content.

In no event shall our total aggregate liability exceed the amount you have paid us (if any) in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Sane and its team from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may stop using Sane and delete your account at any time through the app settings. Upon account deletion, all your personal data will be removed from our active systems within 30 days.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice. We may also discontinue or modify the Service (or any part of it) at any time.

15. Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sane operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

16. Changes to these terms

We may update these Terms of Service from time to time. When we do, we will revise the "Last updated" date at the top. For material changes, we will notify you through the app or by email. Continued use of Sane after changes are posted constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
